Terms of Service

1. Acceptance of Terms

By accessing or using the EstateRecon platform ("Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a managing agency or body corporate, you represent that you have the authority to bind that organisation.

2. Description of Service

EstateRecon provides a cloud-based platform for managing agents and body corporates to automate utility billing, including stepped tariff calculations, mass balance reconciliation, invoice generation, and resident self-service. The Service is designed to support compliance with the Sectional Titles Schemes Management Act (STSMA).

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use.

4. Data Ownership

You retain ownership of all data you upload to EstateRecon, including meter readings, unit information, resident details, and billing records. We do not claim ownership of your data and will not use it for purposes other than providing the Service.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorised access to any part of the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Upload malicious software or content
  • Resell or redistribute the Service without prior written consent

6. Billing & Payment

Subscription fees are billed in South African Rand (ZAR) on a monthly or annual basis as selected during registration. We reserve the right to modify pricing with 30 days' notice. Non-payment may result in suspension or termination of access.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable notice. We are not liable for downtime caused by factors outside our control.

8. Limitation of Liability

To the maximum extent permitted by South African law, EstateRecon shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the fees paid by you in the preceding 12 months.

9. Termination

Either party may terminate this agreement with 30 days' written notice. Upon termination, you may request an export of your data within 30 days. After this period, we may delete your data in accordance with our data retention policy.

10. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.
